CANCELLATION RULES - PRIVATE TOURS, LUXURY TRAINS & TRAVEL SERVICES

We would deeply regret your decision to cancel your trip to India. However, we realize that there are many valid reasons that this can happen. A Cancellation must be notified in writing and will take effect the day it is received & acknowledged by Luxury India.

LUXURY INDIA is only a booking agent for tours to India & Other countries and liability of Luxury India is restricted to that of a booking agent only and in no way, Luxury India can be held responsible for any service issues/ deficiency in services of any principal, including Luxury Trains, Hotels, Airlines, Trains, Transport etc.,
Please note that Luxury India or the Train Tour Operators reserve the right to change / amend/ add any rule and that shall be binding on all.

International / USD (United States Dollars) Refunds
- all refund amounts would be calculated on the basis of actual INR (Indian Rupee) value received and any foreign exchange value difference is to be borne by you. LUXURY INDIA shall not be responsible for any such fluctuation in International currency and actual INR receipt shall be taken as base for all calculations. Luxury India reserves to deduct USD 185 per person towards Bank Charges / documentation charges in case of International refunds.

PRIVATE TOURS & HOLIDAY (TOUR PACKAGES, OTHER THAN TRAINS) CANCELLATIONS CHARGES:
- 60 days or before departure 10% is NON refundable
- 59 – 45 Days before departure 30 % is NON refundable
- 44 - 35 Days & less before departure 50 % is NON refundable
- 34 Days & less before departure 100 % is NON refundable
- Domestic Air Ticket, Train ticket, Hotel Bookings are non-refundable.

Luxury Trains Cancellation rules are as per operator policy and may change anytime.

Luxury India retains the rights to change any cancellation / refund policy at any point of time and shall be acceptable to all.

FOR LUXURY TRAIN TOURS – PALACE ON WHEELS, MAHARAJA EXPRESS, GOLDEN CHARIOT & DECCAN ODYSSEY
All cancellations / Amendments requests etc. must be informed and acknowledged by us through email by Luxury India.

For Palace On Wheels:
- There will be a MINIMUM levy of 25% cancellation fee on gross train ticket value -if informed more than 95 days before the train tour departs.
- There will be a MINIMUM levy of 35% cancellation fee on gross train ticket value -if informed between 80 to 94 days prior to train tour depart.
- There will be a MINIMUM levy of 50% cancellation fee on gross train ticket value - If informed between 70 to 79 days prior to departure.
-There will be Full 100% cancellation fee levied on gross train ticket value -if informed less than 69 days or less prior to train tour depart or No Show etc., If 100% ticket value not paid on or before 95 days, the advance shall be forfeited by the operator

For Maharaja Express, Deccan Odyssey & Golden Chariot:
- There will be a MINIMUM levy of 35% cancellation fee on gross train ticket value -if informed more than 75 days before the train tour departs.
- There will be a MINIMUM levy of 60% cancellation fee on gross train ticket value -if informed between 65 to 74 days prior to train tour depart.
-There will be Full 100% cancellation fee levied on gross train ticket value -if informed less than 64 days or less prior to train tour depart or No Show etc.,

IMPORTANT NOTE:
If Due to Covid19 Travel Restrictions Or Low Occupancy Or Any other reason, the Scheduled Depart does not Operate or cancelled by the operator, You Will be Informed At least One Week Before Scheduled Depart, And Have option to adjust advance in Future Journey or a similar value credit note valid for 60 months, or request for a refund of the same. Train Operators reserve the right to amend any tariff / fee / itinerary / cancellations/ refund rules or any rules etc., and any difference in tariff or additional charges is to be paid by the guest only as per the operators rules,

Tour Amendments:
All Amendments are subject to Approvals by authority. Amendments only possible under the circumstances like Natural Disaster / Natural Calamity or Serious Health Problems (this needs to be supported by doctor’s certificate) and are subject to Approval by authority.
Any Amendment in Name / Date of travel is chargeable at MINIMUM 10% OF PUBLISHED TARIFF at least 65 days prior to travel. Also, any change in name / travel date 64 days prior to tour departure shall be treated as cancellation request. In case the Operator cancels trip departure, choose to book it for another date, or shift journey to another booking or seek refund as per the actual INR value received, or shift fund in another trip of your choice.
There is no refund in case of any pre or post tour arrangements like private tours, hotel booking, airlines tickets etc, booked separately than train tours. In case a holiday is cancelled under `force majeure" (situation beyond our control like war, earthquake, flood, civil/ military authority, industrial disputes, strikes, civil unrests, epidemics, disease, or any other similar reason), we regret that no refunds would be possible, and another travel option shall be provided or any other option shall be worked out as per the operator policy.

General Rules:
RTDC / IRCTC / MTDC is the Train Operator and reserves the rights to amend tariff, itinerary, departures, cancellation and refund policy etc., & Luxury India is the booking agent for All Luxury Trains and maximum liability of Luxury India is that of a Booking Agent only.
In special case-where the travel date of the same passengers needs to be postponed to future specific dates, Minimum 10% of the Published Tariff per person will be charged & subject to approval by authority.
Luxury India cannot be held liable to compensate for any additional Financial Loss caused viz Fee towards Cancellation of Air Tickets, Hotel Booking etc or if any Mental Trauma caused for any tariff / itinerary change / trip cancellation etc., for whatever reasons and any advance paid shall be adjusted against the future journey of choice.

All foreign passport holders require valid Indian Visa before traveling to India

Request for refund due to refusal of Indian Visa will not be entertained Or Overseas passenger landing in India without proper travel documents-will be governed by cancellation rules.

No refund will be made in case of no-show Or self-curtailment of journey

Un-willingness to follow tour as per schedule, will be non-refundable

At times, due to local logistics/ conditions, if the tour Manager is forced to cancel certain scheduled sightseeing tours Or activities, at short notice - No refund will be made to passengers to compensate for this.

Request for train tour cancellation due to increase of taxes/tariff by authorities will be governed by cancellation rules.

When a passenger makes a request for refund due to self-cancellation, it will be governed as per foreign exchange rules of RBI Bank and the process may take 6 to 8 weeks after documentation as per RBI guidelines is received.

Luxury Trains reserves the right to charge MINIMUM US$ 380 per person as service charge & refund will be made as per INR Rupees amount received.

All Disputes are Subject to the Jurisdiction of Courts of New Delhi (India)
